Changes in Residential Zoning for New Hyde Park

Propposed changes in residential-C zoning code to allow, as a conditional use, a bakery, sandwich shop or delicatessen.

New Hyde Park has two separate governing agencies. There is the Village of New Hyde Park which is approximately one-square mile south of Hillside Avenue and then the unincorporated Town of North Hempstead. Each municipality has different zoning codes, laws and regulations, different garbage collection and street sweeping among other items. The zoning changes I am going to list below affect only people who reside in the town portion of New Hyde Park.

The Town has been working on changes in residential-C zoning to allow for
the continued use by Dominick's Deli on Herricks Road, as a conditional
use, a delicatessen, bakery or sandwich shop. There are limitations to this
conditional use so that we don't have a proliferation of Subways, Dunkin Donuts
or 7-Elevens, which are:

► the establishment is situated on a thoroughfare with four or more travel
lanes (Hillside Avenue, Lakeville Road, New Hyde Park Road, Denton Avenue,
Marcus Avenue)

► lot shall be NO LESS than 1.5 acres (that means it would take 13 of our
properties together to qualify)

► there shall be no tables or chairs for the on-premises consumption of
food

► gross floor area should be no greater than 4,000 square feet

► there shall be no drive-through service windows

If anyone has any thoughts about how there might be an area that would meet
this criteria in our community please let me know. Our goal is to protect the
residential areas from becoming more and more "citified." There will be public
meetings about this shortly - we are being proactive in this case.
